Acceptable Use Policy
This Acceptable Use Policy ("AUP") governs your use of all Fotante services, including our consumer application, Studio (our collaborative workspace), REST API, and command-line interface ("Services"). These terms apply to all users and are incorporated by reference into our Terms of Service. Violation of this AUP may result in account suspension or termination.

1. Overview
This policy establishes standards for responsible and lawful use of Fotante Services. We are committed to maintaining a secure, trustworthy platform and reserve the right to enforce these standards to protect our users, infrastructure, and legal obligations.
The prohibited conduct described below applies across all Fotante products and services: the consumer application, Studio workspaces, API access, CLI tools, and any other service or feature we offer. Regardless of which service you use, you agree to abide by these standards.
2. Prohibited Content
You may not upload, store, transmit, or otherwise use the Services to host or distribute:
- Illegal content: Content that violates applicable laws, including obscene material, content promoting violence, or content that facilitates illegal activity
- Child Sexual Abuse Material (CSAM): We have an absolute zero-tolerance policy for CSAM and content that sexually exploits minors. Any account found storing, distributing, or seeking such content will be immediately and permanently terminated. We will preserve evidence and report such activity to the National Center for Missing and Exploited Children (NCMEC) and relevant law enforcement authorities. - Non-consensual intimate imagery: Intimate images or videos shared without consent of all depicted individuals, including deepfakes or manipulated intimate content
- Content facilitating violence or terrorism: Content that incites, glorifies, or provides instructions for violence, terrorism, or self-harm
- Copyright-infringing content at scale: Systematic uploading of copyrighted content without authorization, especially for the purpose of distribution or commercial exploitation. Isolated instances may be addressed through standard copyright takedown procedures
3. Prohibited Conduct
In addition to prohibited content, you may not engage in the following activities:
- Unauthorised scraping and crawling: Using automated tools, bots, or scripts to scrape, crawl, or extract data from the Services without our prior written permission. This includes extraction of user data, content libraries, or metadata
- API abuse: Exceeding rate limits, sharing or reselling API credentials, using API keys on behalf of other users, or accessing the API through circumvention techniques. Rate limit evasion through distributed requests or credential pooling is prohibited
- Competitive intelligence extraction: Systematically using the API or Services to extract data for the purpose of building competing products or market intelligence
- Account farming: Creating multiple accounts to circumvent usage limits, obtain additional free trials, or artificially inflate metrics. This includes creating accounts on behalf of other parties without their direct involvement
- Impersonation: Impersonating another user, organisation, or individual, or misrepresenting your identity or affiliation
- Interference with other users: Attempting to gain unauthorised access to other users' accounts, content, or data. This includes social engineering, credential theft, or exploiting security vulnerabilities
- Service disruption: Attempting to disrupt, degrade, or interfere with the availability, functionality, or security of the Services or infrastructure
4. API and Developer Use
Fotante offers API access to Pro and Team plan subscribers. The following terms apply to all API and developer tool usage:
- Permitted uses: API access is granted for personal use, internal business tooling, and third-party applications or integrations that enhance your use of Fotante. You may build applications that complement or integrate with Fotante, provided they do not duplicate or compete with Fotante's core functionality
- Prohibited uses: You may not use the API or developer tools to build products, services, or platforms that directly compete with Fotante or substantially replicate Fotante's features and functionality
- API credentials: API keys and tokens are personal credentials tied to your account. You are responsible for all activity conducted using your credentials. Do not share API keys, commit them to public repositories, or grant access to other users without our permission. Shared credentials will be revoked
- Rate limits and fair use: All API tiers have defined rate limits. Excessive automated processing that degrades service quality for other users may result in throttling or suspension of your API access. Contact us to discuss custom rate limit arrangements for legitimate high-volume use cases
5. Studio and Organisation Use
Fotante Studio is our collaborative workspace product for teams. The following standards apply to Studio accounts:
- Account operator responsibility: If you are the owner or administrator of a Studio account ("Studio Operator"), you are responsible for ensuring that all members, contractors, and service providers invited to your workspace comply with this AUP and applicable law
- Client data handling: Studio Operators must process client, customer, or third-party data lawfully and in accordance with all applicable data protection regulations (including GDPR, CCPA, and other privacy laws). You must have appropriate legal authority and data processing agreements in place
- Lawful processing only: You may not use Studio to process, store, or analyse data that you do not have legal authority to access or process. This includes processing sensitive data (health information, financial records, etc.) without appropriate safeguards and legal basis
- Third-party data: Do not upload data belonging to third parties without their explicit consent and appropriate contractual arrangements. You remain liable for the lawfulness of data handling within your Studio workspace
6. Storage Quotas and Fair Use
Fotante provides storage as part of your plan to host personal and business media files. The following fair use standards apply:
- Intended use: Storage is provided for your photos, videos, and related media content. It is not a general-purpose file hosting service or backup solution for non-media files
- Non-media files: We reserve the right to review storage usage and reclaim storage used for large-scale storage of non-media files (archives, databases, backups, source code, etc.). Isolated instances may be permitted, but systematic abuse of storage for non-intended purposes may result in storage reclamation or service throttling
- Storage reviews: We may periodically review accounts with unusual storage patterns. If we determine storage is being used in violation of this policy, we will notify you and provide a reasonable opportunity to remedy the situation
7. Enforcement and Remedies
Fotante takes AUP violations seriously. Enforcement actions may include:
- Warnings: For minor or first-time violations, we may issue a written warning and allow opportunity to cure
- Throttling: We may temporarily limit API rate limits, bandwidth, or feature access to prevent further abuse
- Suspension: We may temporarily suspend your account to prevent continued violations, pending investigation or remediation
- Termination: We may permanently terminate your account and access to the Services for serious violations, repeated violations, or conduct that poses risk to the Service, other users, or legal compliance
- No refunds: Accounts terminated for AUP violations are not eligible for refunds of prepaid fees or credits, regardless of the remaining subscription period
- Evidence preservation: We preserve records and evidence of alleged violations to support potential law enforcement investigations and to defend against disputes
8. Reporting Violations
If you discover or suspect a violation of this AUP, please report it to us:
- General abuse: abuse@fotante.com
- CSAM or serious illegal content: trust@fotante.com (or report directly to NCMEC's CyberTipline)
- Security issues or vulnerabilities: security@fotante.com
Please provide as much detail as possible, including account information, dates, and specific content or activity in question. We will investigate all reports and take appropriate action.
9. Changes to This Policy
We may update this AUP periodically to address emerging risks, new services, or changes in law. Material changes will be communicated to affected users by email or prominent notice within the Service at least 30 days before becoming effective. Your continued use of the Services after an update becomes effective constitutes acceptance of the updated policy. If you do not agree with changes, you may close your account before the effective date.
